The Agency for the Protection of Market Competition (AZTN) has initiated administrative proceedings against Krk Store to determine whether it has exploited significant bargaining power as a buyer by imposing unfair trading practices on its suppliers of agricultural and food products.
As AZTN reported on Monday, the proceedings were initiated ex officio, as during the compliance check of retail buyer-trader operations with the provisions of the Law on Prohibition of Unfair Trading Practices in the Food Supply Chain (ZNTP), indications were found that this buyer acted contrary to the provisions of the ZNTP, as highlighted in the announcement on AZTN’s website.
The agency will, as stated, examine all elements related to the content and realization of the business relationships of Krk Store with its suppliers of agricultural and food products in the administrative proceedings, and will only make a substantive decision after fully establishing the factual situation.
AZTN notes that the initiation of administrative proceedings against a specific buyer does not necessarily imply a determination of a violation of the ZNTP, but in the initiated administrative proceedings, AZTN is obliged to establish all relevant facts and circumstances, i.e., specific evidence that confirms the indications that were the reason for initiating the proceedings. Upon completion of the proceedings, the agency will publish its substantive decision on its website.
