The President of the Supreme Court issued a directive on the operation of courts during ‘warning measures’

The President of the Supreme Court Radovan Dobronić issued a directive on Monday, on the first day of the second cycle of the so-called white strike of judicial officials, regarding the operation of courts during the implementation of warning measures by judges and state attorneys who are demanding higher salaries.

Dobronić stated in the directive that the presidents of first-instance and second-instance courts should monitor the court’s work during the implementation of warning measures in such a way that cases in which citizens and entrepreneurs face irreparable damage continue to be resolved.

All other hearings scheduled during the warning measures can be postponed, with a recommendation that parties be simultaneously assigned a new hearing date, while courts in cases where the hearing will not be held should previously send a notice to the parties or their representatives, emphasizes Dobronić.

The president of the highest court notes in the directive that a hearing should be held if the court cannot inform the party about the postponement of the hearing due to short notice and if the party in the case does not have a representative.

Additionally, the presidents of the courts are tasked with technically facilitating communication between the parties and the court through enhanced work of officials at the telephone switchboard, publishing telephone numbers through which parties can obtain information, and publishing an email address through which parties can communicate with the court.

Dobronić instructed the presidents of county courts to inform the presidents of municipal courts about his directive.

UHS: Response greater than 80 percent

On Croatian courts, a new “white strike” of judges began on Monday, which, unlike last year, also included state attorneys.

The Association of Croatian Judges (UHS) previously reported that they are starting a new cycle of warning measures from Monday, stating that court parties have been informed about this, but also that they are open to continuing discussions with the government. The Association of Croatian State Attorneys (UHDD), which did not participate in last year’s judicial white strike, is also involved in the warning measures.

Thus, in the next two weeks, until Friday, February 2, or until an agreement is reached regarding the salaries of judicial officials, all actions in first-instance and second-instance court proceedings are postponed, except in urgent cases where irreparable damage could occur.

UHS reported on Monday that the response to the warning measures from Croatian judges is greater than 80 percent, which is higher than in the first cycle of measures in May 2023, while in some cities, the response of judges is even one hundred percent.

Judges and state attorneys are demanding the adoption of a Law on Salaries and Material Rights of Judicial Officials, which will fully regulate the salaries and other material rights of judicial officials, in accordance with the standards achieved in EU member states.
