Minister Bošnjaković: We are returning enforcement to the jurisdiction of the courts

Minister of Justice Dražen Bošnjaković on Tuesday presented the first working version of the new enforcement law, which would return enforcement based on authentic documents to the jurisdiction of the courts, with public notaries participating in the process only as court commissioners.

The innovations proposed in the draft by the working group are expected to introduce greater protection for debtors, reduce the costs of enforcement proceedings, abolish the possibility of fiduciary registration of ownership on the debtor’s property, improve electronic communication, increase the security of delivery, expand the circle of those exempt from enforcement, introduce an obligation to inform debtors about the initiation of enforcement, and prohibit evictions during the winter months.

“The proposed law offers a faster, simpler, and cheaper system,” said Bošnjaković at a press conference on Tuesday. He expects that work on the new law will be completed by the end of the year, after which government and parliamentary procedures will follow.

According to the minister, the lowest cost of enforcement proceedings should be 300 kuna, instead of the current maximum of over 1,800 kuna. He also stated that the courts have sufficient capacity for additional work and that the notaries in the working group did not object to the reduction of powers.

“As a state, we have the right to determine the rules of procedure,” concluded Bošnjaković, stating that the law does not fully resolve the issues of blocked individuals but introduces clearer rules.
