Photographing a Military Facility in Gospić Led Him to Court

Due to photographing a military facility with a clearly marked sign prohibiting photography, a 28-year-old man will face misdemeanor charges, the Gospić Police Department reported on Wednesday.

The citizen photographed the ‘Eugen Kvaternik’ barracks in Gospić with his mobile phone on Sunday, April 1, around 3 PM, and he was noticed in the act and will be sanctioned, either with a fine or by being sent to jail, said Kristina Orešković, spokesperson for the Lika-Senj Police Department, to Hina.

This is a violation of public order and peace, specifically a breach of the order prohibiting access or staying, photographing, or sketching at a certain location, Orešković explains, adding that misdemeanor proceedings are conducted under the Misdemeanor Act adopted from the former state, and the fine is set as “the equivalent of domestic currency from 50 to 200 German marks or a prison sentence of up to 30 days.”

The president of the Misdemeanor Court in Gospić, Žana Vlainić, told Hina that the case has not yet reached them, but she can generally say that the form of guilt, i.e., intent, will be determined, whether it is negligence or if the suspect photographed the barracks for a more serious purpose.

It should be noted that the police will also be present at the main hearing as the authorized prosecutor, and if malicious motives are established, further investigation may be conducted, and on the other hand, a monetary fine, imprisonment of up to thirty days, or even an acquittal may be pronounced, said Judge Vlainić.
