Information Commissioner Anamarija Musa confirmed the warnings of Croatian taxi drivers that the Ministry of the Sea, Transport and Infrastructure did not comply with legal procedures and failed to publish the requested report on public consultation regarding the proposed law on road transport, and requested the Ministry to publish that report within the next 15 days, it was announced on Saturday.

Namely, the Information Commissioner received a complaint from the Dubrovnik Association of Craftsmen of taxi carriers, represented by lawyer Bojan Lujak, which points to violations by the Ministry in the implementation of the Law on the Right to Access Information, specifically the non-publication of the report after the public consultation on the impact assessment of the regulations for the Draft Proposal of the Law on Road Transport. The complaint to the Information Commissioner also states that the Government of the Republic of Croatia adopted the final proposal of the Law on Road Transport in 2018 and proposed its adoption through an urgent procedure, without a report submitted after public consultation.

Therefore, she requested the Ministry of the Sea, Transport and Infrastructure to publish that report within the next 15 days.
– Upon reviewing the e-consultation page, it was determined that the public consultation lasted from December 1, 2017, to December 31, 2017, and it was announced that the expected publication of the report was on January 30, 2018, however, the report was not published, states Information Commissioner Musa in the complaint.

The law stipulates that upon the expiration of the deadline for submitting opinions and proposals, the public authority is obliged to prepare and publish on the central state internet portal for public consultation or website, a report on public consultation, which contains received proposals and comments as well as statements with reasons for rejecting certain proposals and comments, it is added.
Considering that the latest version of the Law on Road Transport clearly states and explains that the Law should be sent for urgent procedure, this represents a clear favoring of Uber, believes the president of the Taxi Carriers Association at the Croatian Chamber of Trades and Crafts, Božo Miletić.
