Šeparović: ‘Lex Agrokor’ most likely to come before constitutional judges

The Constitutional Court has not received a proposal for the assessment of the constitutionality of the so-called lex Agrokor, said the president of that institution, Miroslav Šeparović, to reporters, who expects that this law will most likely come before constitutional judges and does not want to prejudge the opinion of his colleagues.

However, Šeparović says that he can generally state that all constitutional rights can be limited in accordance with the principle of proportionality if there is a legitimate goal in the public interest and if there is proportionality.

“Whether this has been done here, whether there is a public interest, whether there is proportionality, whether the measures are appropriate and necessary at this moment, I cannot speak, but I can speak about the principle that the Constitutional Court follows,” said Šeparović after the announcement of decisions regarding the Swiss franc law and local elections.

In response to a journalist’s note that there has been much talk in recent days about the possible unconstitutionality of this law, Šeparović said that some have pointed out that the law is unconstitutional, while others have said that it is unconstitutional if the government does not act, and that he cannot say anything.

“I can only repeat in principle that all constitutional rights, except the right to life, can be limited if it is in accordance with constitutional law,” said Šeparović, adding that he does not know whether or not this has been done in accordance with the Constitution in this specific case.
