Government on Strategic Investments and Pension Insurance

The amendments to the Criminal Procedure Act (CPA), which are to be presented to the government, propose that the state attorney’s office must file an indictment or abandon the ‘prosecution’ of the accused within a maximum of two and a half months from the completion of the investigation.

This is just one of a series of proposed amendments to the CPA that the Ministry of Justice has prepared after the Constitutional Court partially or fully annulled 43 provisions of that law in July, in order to ensure a higher level of legal protection for victims and defendants, and more effective tools for the prosecution.

The amendments, which have undergone extensive expert public discussion, propose that the state attorney’s office must charge the accused within 15 days or abandon the criminal prosecution, while in complex cases, this period is 30 days. These deadlines can be extended by 15 days, or in complex cases by 30 days.

The government will also discuss the final proposal for the law on strategic investment projects of the Republic of Croatia, which aims to facilitate the initiation of the investment cycle. According to the final proposal, representatives of local government units, i.e., county and city mayors in whose area the investments are to be realized, would also be involved in the decision-making process regarding the granting of strategic investment status through participation in the work of the commission for the selection of strategic projects. Additionally, the responsibility of civil servants for the swift resolution of administrative procedures is established.

On the agenda are also amendments to the Pension Insurance Act aimed at excluding attempts to abuse medical documentation in the process of determining rights based on disability. The proposed law allows for the suspension of pension payments in cases where the Institute cannot officially obtain the data or document necessary for the payment of the pension, and the party does not provide them within the deadline.

Ministers will also consider amendments to the Employment Mediation Act and rights during unemployment, which enable individuals engaged in self-employment to acquire the right to unemployment benefits, provided that the cessation of that activity occurred for justified reasons.
