The Government of the Republic of Croatia has given preliminary consent to the Government representative for the acceptance of the amendment of the Parliamentary Committee for Legislation to Article 29 of the Final Proposal of the Law on Amendments to the Labor Law (ZOR).
This amendment improves the nomotechnical expression of the mentioned provision, the Government’s Public Relations Office announced this evening.
Additionally, the Government submitted two amendments to the same Final Proposal of the Law.
-The first amendment to Article 6 removes possible doubts regarding the protection of workers’ rights in cases of unjustified reasons for dismissal, especially if the dismissal would essentially be a result of the worker addressing state authorities due to justified suspicion of corruption.
This amendment undoubtedly prescribes the right of workers to judicial protection, i.e., to contest the dismissal due to failure to meet the probationary period. In this sense, it is also proposed that the application of the institute of unjustified reasons for dismissal, provisions on the form, justification, and delivery of the dismissal, as well as the reinstatement of the worker in cases of unjustified dismissal, be explicitly prescribed for dismissal based on this ground.
The second amendment corrects the incorrect use of language expression in Article 25, as stated in the announcement.
