The Management of Brodosplit Seeks Oversight of Public Procurement of Vessels for Jadrolinija

The Management of Brodosplit has requested the Ministry of Economy to oversee the public procurement process for four ro-ro vessels for Jadrolinija, stating that private shipbuilders offered unrealistically low prices in the repeated tender for the construction of these vessels, which puts Brodosplit at a disadvantage, as the Management claims to have offered a realistic price for the construction of these vessels.

In today’s statement, the Management of Brodosplit reminds that it reported irregularities in the repeated tender for the procurement of four vessels for Jadrolinija to the Ministry of Economy on February 13 of this year.

-Brodosplit has initiated that the Ministry of Economy commence oversight of this public procurement process, which it is obliged to do no later than eight days from the date of receipt of Brodosplit’s complaint. If the Ministry of Economy identifies irregularities, which we believe are indisputable, the Ministry may, in accordance with its powers, file a charge against the responsible persons with the competent misdemeanor court. Furthermore, the Ministry of Economy can, and we request that it does, indicate to Jadrolinija the need to annul the public procurement process on the grounds that the selection of the bidder according to the stated criteria would be in direct contradiction to the fundamental legal principles of the Republic of Croatia, states the statement from the Management of Brodosplit.

According to the claims of the Management of Brodosplit, all three privately-owned shipyards offered an unrealistically low price for the construction of the first of the four vessels, which, due to the scoring method, can create an unattainable advantage over other bidders.

On the other hand, Brodosplit has offered a realistic price for each vessel, including the first one, as well as realistic delivery deadlines, claims the Management of that shipyard.

-In the end, the strange method of evaluating bids can lead to an absurd situation. Although the purpose/goal of the open public procurement procedure is to select the economically most advantageous offer, in this tender it is possible for the bidder with the worst (highest) total price for the four vessels to receive the highest number of points, while the delivery deadlines for the vessels are the most unfavorable, states the statement from the Management of Brodosplit.
