The Franak Association has sent a statement supporting the efforts of Minister Slavko Linić to protect the rights of workers who have taken out loans with variable interest rates that change based on the arbitrary decisions of banks.
– We believe that the Government will recognize the necessity to ensure that in all areas where the Law on Credit Institutions provides protection for consumer-loan users, this rights and protection also apply to existing users (those who have already entered into contracts earlier) as well as those who will enter into contracts after the enactment of this Law – states the Association’s statement.
They warn that otherwise there will be an unequal position between existing and future loan users, which can be considered discriminatory, as one group of citizens will have greater legal certainty and protection, and access to rights, than the other, at a time when both groups have a contractual relationship with the same credit institution.
They also called on the Government to analyze Directive EC 2008/48 on consumer credit agreements (Council Directive on credit agreements for consumers), and the Directive on unfair terms in consumer contracts (Council directive on unfair terms in consumer contracts).
