Costs of Pre-Bankruptcy Settlement Still Unregulated

The provisions of the Law on Financial Operations and Pre-Bankruptcy Settlement state that ‘the Minister of Finance is authorized to prescribe a tariff for conducting the pre-bankruptcy settlement procedure by regulation within 30 days from the date of entry into force of the Law.’

Since the Law came into force on October 1, the 30-day deadline has expired. 

In Fina, which conducts these procedures, they say that the regulation that will govern the costs arising from the Law has not yet been adopted. As is customary, there has been no response from the Ministry of Finance within the given timeframe, so entrepreneurs can still hope that the costs of conducting the pre-bankruptcy settlement procedure ‘will not be high,’ as has been informally heard so far.
