The misdemeanor court in Zagreb publicly announced a non-final verdict declaring Hrvatski Telekom and the responsible person at Hrvatski Telekom guilty of violating the Electronic Communications Act, according to a statement from HAKOM.
The verdict was reached because during HAKOM’s expert supervision, Hrvatski Telekom refused to provide documentation containing internal data on the parameters and method of calculating capital costs. Following the first-instance proceedings initiated by HAKOM, the misdemeanor court in Zagreb imposed fines totaling 40,000 kuna on Hrvatski Telekom and the responsible person. Given that this case involves a serious violation of the Electronic Communications Act, for which the same law prescribes a fine of up to one million kuna, the imposed fine is relatively small compared to the severity of the offense committed and insufficiently sanctions the behavior of Hrvatski Telekom, which hinders the liberalization of the electronic communications market in the Republic of Croatia.
