The Council of the Competition Protection Agency has deemed the concentration resulting from the acquisition of joint control or dominant influence by the entrepreneurs M SAN Investments, Žito, and Vaga over the companies Termes and IPK Kandit Osijek, through the acquisition of a majority stake in the share capital of Termes, to be permissible, as announced from the Council’s session.
Through the implementation of the concentration, M SAN Investments, Žito, and Vaga, which do not operate in the wholesale market of confectionery products, will acquire the market share of IPK Kandit, while the market shares of other entrepreneurs will remain unchanged. In the relevant wholesale sugar market in the territory of the Republic of Croatia, after the implementation of the concentration, M SAN Investments, Žito, and Vaga will take over the market share of the sugar producer IPK Premijera, a related entrepreneur to IPK Kandit. According to the announcements from the participants of the concentration, the operations at IPK Kandit will be based on investment in the development of the confectionery industry by focusing activities on the development of new products, candies, chocolates, and cream products, which will increase market competitiveness, it is stated in the announcement.
