The Construction Inspection of the Ministry of Environmental Protection, Physical Planning and Construction has published its first report regarding the construction of the HEP business building on Kupska Street in Zagreb, stating that violations of the Construction Act have been identified during the inspection and that appropriate charges will be filed against those responsible.
The Construction Inspection determined that the professional supervision and supervising engineer are at fault for not overseeing the construction and ensuring that the work is carried out in accordance with the law and the permit. The contractors, Zagreb companies "Tehnika" d.d. and CONEX d.o.o., are guilty of not constructing in accordance with the building permit.
The company CONEX is at fault because the execution project was not prepared in accordance with the main project. The report states that the investor HEP obtained a building permit for the construction of a business building with an underground garage consisting of six underground levels. The contractor is "Tehnika", and the work on the protection of the construction pit is carried out by the Zagreb company CONEX. For further inspection procedures, documentation was taken from the construction site – the construction diary of the contractor "Tehnika" and the projects of the company CONEX. It was determined that the construction diary of "Tehnika" was not signed by the supervision on July 24, 2007, and the relevant construction authority of the City of Zagreb was requested to provide the building permit file, which was delivered to the inspection on September 24, 2007.
It was established that the project for the protection of the construction pit was prepared by the Zagreb company Prizma in April of last year, and that the protection of the construction pit is being built based on the project of CONEX, titled main – execution project, from March of this year, which has the stamp of revision by the authorized auditor. The inspection determined that the described projects do not address the stability of the diaphragm in the same way and that the CONEX project, in relation to the Prizma project, contains changes in the concept of ensuring the protection of the construction pit, which affect essential requirements for the construction without location conditions. For example, the Prizma project anticipated a diaphragm thickness of 60 cm and a length of 24 to 28 meters, then that anchors are executed in 5 rows with lengths of 18.5 to 25.5 m, while the CONEX project reduced the diaphragm thickness to 50 cm and the length to 19 to 20 m, and the number of anchors was reduced to four rows with lengths from 10 to 19 meters. Verification with the relevant construction authority of the City of Zagreb established that the investor did not obtain confirmation from that authority for the modified project, i.e., the project of the company CONEX.
Further inspection will determine the circumstances regarding the measurement and oscillation of the diaphragm as provided by the control and quality assurance program, which is an integral part of the construction pit protection project, states the report of the Construction Inspection of the Ministry of Environmental Protection, Physical Planning and Construction.
